Conditions of entry and limitation of liability

1.If you bring a Vehicle into this Car Park you agree to pay the parking fee as set by us from time to time and posted on our website. Regular parking must be paid for a minimum of two weeks in advance on an ongoing basis.

2.Permits are issued for a particular car (the number plate of which will be displayed on the permit) and are not transferable without prior notification. The purchase of a permit entitles the holder to park in a designated parking section which will be allocated and shown on the permit. If for any reason you require to bring an alternative car into the carpark (instead of your nominated vehicle) and it does not have your normal parking permit, you must apply for a temporary change of vehicle at least 24 hours prior. In the event that you will not be parking due to prolonged illness or a holiday period for two weeks or longer, you may sublet your parking space to another but you will still be responsible for making the regular payments. In all cases, you must have prior permission or additional parking fees may charged. A temporary permit will be issued to the sublet for the period of the sublet period.

3.You will be issued with a gate key to give access to the car park. You agree:

•not to make a copy of the key

•not to give the key to any other person without prior permission as outlined in point 2.

•to only use the key for access for the nominated vehicle and not to give access to any other vehicles

•to close the gate after each entrance and exit from the car park. The gate is to be closed at all times. Failure to do so, may result in the immediate cancellation of your parking permit without refund.

4.You agree to: be provided and the driver must agree to the parking conditions prior to using the car park.

3.You will be issued with a gate key to give access to the car park. You agree:

•not to make a copy of the key

•to only use the key for access for the nominated vehicle and not to give access to any other vehicles

•advise us immediately should you lose your key and pay for a replacement. This will be “at cost” providing that you are not in arrears at the time in which case the fee will be $150.

•to close the gate after each entrance and exit from the car park. The gate is to be closed at all times. Failure to do so, may result in the immediate cancellation of your parking permit without refund.

•to return the key (as advised by us) within two working days of the end of your parking contract. Failure to do so, will result in replacement fee of $150.

4.You agree to:

•only use your designated car space

•not to park anywhere that we designate as a no parking area;

•not to use this car park other than in accordance with instructions that an authorised officer may give;

•comply with all reasonable directions and requests made by an authorised officer of the Lawson Unit Trust.

•contact the Lawson Unit Trust in the event of any problems relating to the car park and understand that the car park is in no way connected with GE. You agree not to provide access, a key or ask any GE staff to resolve any issues relating to the car park use as Martin Street Park is independent from GE.

5.These conditions may only be altered by a written agreement between you and us.

6.Either party may terminate this agreement with two weeks notice.

7.You enter and use this car park at your own risk.

8.We are not liable for you or any person with you for:

•injury to you or anybody else;

•damage to, destruction of, theft of or unauthorised delivery up of your vehicle or any other vehicle whether authorized or not; or

•damage to, destruction of, theft of or delivery up of any property (Including anything in or on your vehicle or any other vehicle); however caused, and you release and indemnify us from any claim, which you might otherwise have against us.

9.You agree to indemnify us in respect of any claim made against us as a consequence of, in relation to, or in any way arising out of the use of this car park.

10.We will not be liable to you for delivery of your vehicle to any person who did not have authority to take your vehicle.

11.If any of these conditions are illegal or unenforceable, the offending part is to be disregarded and does not affect the remaining part.

12.Each exclusion of our liability in these conditions is subject to any law which restricts or forbids that exclusion of liability including the Trade Practices Act and similar State legislation.

13.In these conditions references to: "we", "us" and "our" mean Kaylene Lawson and the Lawson Unit Trust; "your vehicle" includes a vehicle driven, or intended to be driven by you into the Car Park.
